These Terms of Service ("Terms") are a binding agreement between you and Equilibrium04 ("Equilibrium04", "we", "us"), a company registered in the Republic of Türkiye (Emniyetevler, 34415 İstanbul, Türkiye), which operates the Peakd mobile application ("Peakd" or "the App"). By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to use Peakd. By using the App, you represent and warrant that you are 18 or older and legally able to enter into these Terms.

2. What Peakd is

Peakd analyzes a photo of your face using on-device and cloud-based facial-landmarking technology, produces aesthetic scores and measurements, and generates personalized grooming, styling, and wellness suggestions.

Peakd is a self-improvement and entertainment tool. It is not a medical, dermatological, psychological, cosmetic, or other professional service, and it does not provide professional advice or a diagnosis. Scores, measurements, and tips are automated estimates and opinions generated by software and are inherently subjective. Do not rely on Peakd for any medical, health, or other important decision; consult a qualified professional instead.

3. Your account

Some features require an account, which you can create by signing in with Google or Apple. You are responsible for activity under your account and for keeping access to it secure. You may delete your account at any time from within the App or via our account deletion page; deletion is handled as described in the Privacy Policy.

4. Subscriptions, billing, and cancellation

Peakd offers optional auto-renewing subscriptions that unlock paid features.

• Purchases are processed by the Apple App Store or Google Play and are also governed by their terms. Payment is charged to your store account when you confirm the purchase.
• Subscriptions automatically renew for the same period and price unless you cancel at least 24 hours before the end of the current period.
• You can manage or cancel a subscription at any time in your Apple App Store or Google Play account settings. Deleting the App does not cancel a subscription.
• We use Adapty, a subscription-management service, to verify and manage subscription entitlements.
• Refunds are issued by Apple or Google under their respective policies; we generally cannot grant refunds directly. Any statutory right of withdrawal or refund you have under applicable consumer law is unaffected by this section.
• We may change subscription prices or the features included. We will give notice as required by the app stores and applicable law, and a price change will not apply to a period you have already paid for.

5. Your content

When you submit a photo or other content to the App, you grant Equilibrium04 a limited, non-exclusive, worldwide licence to host, store, process, and analyze that content solely to provide and improve the App's features for you, as described in the Privacy Policy. You retain all ownership of your content. We do not use your photos to train machine-learning models. You represent that you have the right to submit any photo you upload, and that it depicts you or a person who has consented to its analysis.

6. Acceptable use

You agree not to:

• use the App for any unlawful purpose, or in violation of these Terms;
• upload photos of other people without their consent;
• upload content that is illegal, harmful, hateful, or infringing;
• attempt to reverse-engineer, decompile, or extract source code or models from the App;
• interfere with, disrupt, or place undue load on the App or its infrastructure;
• access the App through automated means, or resell or commercially exploit it without our permission.

7. Intellectual property

The App — including its software, design, scoring system, text, and branding — is owned by Equilibrium04 or its licensors and is protected by intellectual-property laws. We grant you a personal, non-transferable, revocable licence to use the App for your own non-commercial use, subject to these Terms. The name "Peakd" and our logos may not be used without our prior written permission.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not warrant that scores, measurements, or tips are accurate, complete, reliable, or suitable for any particular purpose, or that the App will be uninterrupted or error-free.

Aesthetic assessment is inherently subjective, and any results are for general informational and entertainment purposes only. You use the App, and act on its output, at your own discretion and risk. If the App's content causes you distress or affects your wellbeing, please stop using it and consider speaking with a qualified professional.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Equilibrium04 will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the App. To the fullest extent permitted by law, our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the twelve months before the claim, or USD 50. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including your mandatory rights as a consumer.

10. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold Equilibrium04 harmless from claims, damages, and reasonable expenses (including legal fees) arising from your misuse of the App or your breach of these Terms.

11. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the App. Provisions that by their nature should survive termination — including content-licence terms already granted, disclaimers, limitation of liability, and governing law — will survive.

12. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, ask you to review the revised Terms in the App. Continued use of the App after an update means you accept the revised Terms.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-laws rules. The courts and enforcement offices of İstanbul, Türkiye will have jurisdiction over any dispute. This does not deprive you of the protection of mandatory consumer-protection laws of your country of residence, including any right to bring proceedings before your local courts or, for consumers in Türkiye, the relevant Consumer Arbitration Committee ("Tüketici Hakem Heyeti").

14. App stores

Peakd is distributed through the Apple App Store and Google Play. These Terms are between you and Equilibrium04 only, and not with Apple Inc. or Google LLC; Apple and Google are not responsible for the App or its content. Where the App is obtained through the Apple App Store, you acknowledge that Apple has no obligation to provide maintenance or support for the App; that Apple is not responsible for any product warranties or for addressing any claims relating to the App; and that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government restricted-parties list.
